Terms and Conditions

PREAMBLE

These General Terms of Service (hereinafter "GTS") aim to define the rights and obligations of the parties within the framework of the commercial relationship between SomnioCare and its clients. They complement the General Terms of Sale and apply to all interactions with the SomnioCare brand, whether online purchases, email communications, contacts via social networks, or any other form of engagement with our services.

SomnioCare is a brand dedicated to well-being and sleep optimization. Our products are carefully selected to guide our clients towards better sleep quality, with a lifestyle rather than a medical approach.

By accessing our website somniocare.com or placing an order, the Client acknowledges having read and unreservedly accepted these GTS.

SomnioCare is registered with the Crossroads Bank for Enterprises (BCE) in accordance with current Belgian legislation.


Article 2 — Access to the site and services

2.1 General Access

The somniocare.com website is accessible 24/7, subject to cases of force majeure, scheduled technical maintenance, or any circumstance beyond SomnioCare's control. SomnioCare cannot be held responsible for temporary interruptions to website access.

2.2 Terms of Use

Access to and use of the website are reserved for strictly personal and non-commercial use. The Client agrees not to use the website for unlawful, fraudulent purposes or purposes contrary to these GTS. Any unauthorized access to the website's computer systems is strictly prohibited and subject to legal prosecution.

2.3 Client Account Creation

The Client may place an order as a guest or by creating a personal account. Account creation requires the provision of accurate, complete, and up-to-date information. The Client is solely responsible for the confidentiality of their login credentials and for any activity carried out from their account. In case of loss or theft of their credentials, the Client must immediately inform SomnioCare at support@somniocare.com.

2.4 Client Responsibility

The Client undertakes to use the SomnioCare website and services in good faith, not to disrupt the normal operation of the website, and not to attempt to access data not intended for them.


Article 3 — Nature of products and services

3.1 Wellness Products

The products offered by SomnioCare are exclusively wellness accessories and products intended to promote an environment conducive to sleep. These include sleep masks, aromatherapy diffusers, ergonomic pillows, white noise machines, textile sprays, and any other product in the SomnioCare range.

3.2 Absence of Medical Purpose

SomnioCare products are in no way medical devices within the meaning of European regulations (EU Regulation 2017/745). They are not intended to diagnose, prevent, monitor, treat, or alleviate a disease or sleep disorder of pathological origin. In case of persistent sleep disorders, suspected sleep apnea, or any other medical condition, the Client is strongly encouraged to consult a doctor or a sleep specialist.

3.3 Results Not Guaranteed

SomnioCare is committed to offering quality products carefully selected. However, sleep improvement results may vary from person to person depending on many individual factors. SomnioCare does not guarantee specific results regarding improved sleep quality.

3.4 Product Information

SomnioCare strives to provide product descriptions that are as accurate and complete as possible. The visuals presented on the website are for illustrative purposes. Slight variations in shade or texture may exist between the photos and the products received, notably due to screen display settings. These minor variations do not constitute a valid reason for return.


Article 4 — Order Process

4.1 Order Steps

Placing an order on somniocare.com follows these steps:

First step: selection of products and addition to cart. Second step: cart and quantity verification. Third step: entry of delivery information. Fourth step: selection of delivery method. Fifth step: selection of payment method and validation. Sixth step: order confirmation by email.

4.2 Order Confirmation

A confirmation email is automatically sent to the Client upon payment validation. This email summarizes the products ordered, the total amount, the delivery address, and the estimated delivery time. This email constitutes SomnioCare's acceptance of the order and forms the sales contract between the parties.

4.3 Modification and Cancellation

Any request for modification or cancellation must be sent to support@somniocare.com as soon as possible after the order. SomnioCare will do its best to accommodate this request but cannot guarantee a modification once the order has been transmitted to the supplier for shipment. If cancellation is no longer possible, the Client may exercise their right of withdrawal upon receipt of the package in accordance with Article 8 herein.

4.4 Out of Stock

In case of product unavailability after order validation, SomnioCare will inform the Client by email as soon as possible and will offer either an equivalent substitute product or a full refund. The Client is free to accept or refuse the substitute product.


Article 5 — Pricing and Invoicing

5.1 Price Display

All prices displayed on somniocare.com are expressed in Euros and include the applicable VAT at the current rate in Belgium. SomnioCare reserves the right to modify its prices at any time without notice. The applicable price is the one displayed at the time of order validation.

5.2 Promotional Codes

Discount codes are strictly personal, valid only once unless otherwise stated, and cannot be combined with other promotional offers unless explicitly mentioned. A promotional code cannot be applied retroactively to an order already placed.

5.3 Invoicing

An invoice is available for each order. The Client can download it from their client area or request it at support@somniocare.com. For professional clients wishing an invoice with a VAT number, please make the request before validating the order.

5.4 Payment Security

All transactions made on somniocare.com are secured by an SSL (Secure Socket Layer) protocol guaranteeing the encryption of banking data. SomnioCare never stores its clients' banking details. Payments are processed by PCI-DSS certified providers.


Article 6 — Delivery and Shipping

6.1 Delivery Zones

SomnioCare delivers to all countries of the European Union as well as to some non-EU countries. Available countries are indicated during the order process. SomnioCare reserves the right to refuse an order to a particular destination in case of logistical or regulatory constraints.

6.2 Deadlines and Methods

Detailed delivery times and costs are specified in our Shipping Policy available on the website. These times are indicative and run from the shipping confirmation. SomnioCare cannot be held responsible for delays attributable to carriers, customs, or force majeure events.

6.3 Transfer of Risks

The transfer of ownership and risks related to the products occurs when the package is taken over by the carrier. After this moment, SomnioCare cannot be held responsible for the loss, theft, or deterioration of the products, except in cases of proven fault on its part.

6.4 Delivery Problems

In case of a lost, damaged, or undelivered package beyond the maximum indicated period, the Client must contact SomnioCare at support@somniocare.com. An investigation will be opened with the carrier. SomnioCare undertakes to propose a solution (reshipment or refund) within a reasonable time after this investigation.


Article 7 — Customer Service

7.1 Contact Channels

SomnioCare customer service can be reached by email at support@somniocare.com and via the chat available on the somniocare.com website. SomnioCare undertakes to respond to any request within a maximum of 24 working hours, from Monday to Friday.

7.2 Service Commitments

SomnioCare is committed to handling each request with seriousness, care, and efficiency. Each client is treated individually and with respect. SomnioCare undertakes to propose concrete solutions for each reported situation, within reasonable limits.

7.3 Service Language

SomnioCare customer service is available in French and Dutch. Requests in English are also accepted.

7.4 Client Reviews

SomnioCare encourages its clients to share their experience via the review systems integrated into the website. SomnioCare undertakes never to falsify, delete, or modify client reviews, except in cases of manifestly offensive, unlawful, or irrelevant content unrelated to an actual purchase.


Article 8 — Right of Withdrawal

8.1 Legal Period

In accordance with European Directive 2011/83/EU transposed into Belgian law, the private Client has a period of 14 calendar days from the physical receipt of the product to exercise their right of withdrawal, without having to justify their decision or incur penalties.

8.2 Exercise of the Right

To exercise this right, the Customer must notify SomnioCare of their decision by email at support@somniocare.com before the expiration of the 14-day period. The Customer may use the standard withdrawal form below or any other unambiguous statement expressing their wish to withdraw.

Standard withdrawal form:

"To SomnioCare — support@somniocare.com. I hereby notify you of my withdrawal from the contract for order number [number], received on [date]. Customer name: [name]. Address: [address]. Date: [date]. Signature (if paper form): [signature]."

8.3 Exceptions to the right of withdrawal

In accordance with Article VI.53 of the Belgian Code of Economic Law, the right of withdrawal does not apply to products unsealed by the consumer after delivery that cannot be returned for reasons of hygiene or health protection. This includes sleep masks that have been worn or whose hygienic packaging has been opened.

8.4 Refund

In the event of a valid withdrawal, SomnioCare will refund all sums paid, including initial delivery costs, within 14 days of receipt of the returned product. The refund will be made using the same payment method as used during the order.


Article 9 — Guarantees

9.1 Legal guarantee of conformity

In accordance with Articles 1649bis et seq. of the Belgian Civil Code, SomnioCare is obliged to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. Any lack of conformity that appears within two years from the delivery of the goods is presumed to have existed at the time of delivery, unless proven otherwise.

9.2 Guarantee against hidden defects

SomnioCare is also liable for hidden defects in the sold item that render it unfit for its intended use, or that diminish this use to such an extent that the Customer would not have purchased it if they had known about them.

9.3 Implementation

To claim a guarantee, the Customer must contact SomnioCare at support@somniocare.com, describing the defect observed and providing photos if possible. SomnioCare will evaluate the request and propose a repair, replacement, or refund, as appropriate.


Article 10 — Liability

10.1 Limitation of liability

SomnioCare's liability is limited to the amount of the order concerned. SomnioCare cannot be held responsible for indirect, immaterial, or consequential damages resulting from the use or inability to use its products.

10.2 Force majeure

SomnioCare cannot be held responsible for the total or partial non-performance of its obligations in case of force majeure, including natural disaster, strike, pandemic, war, telecommunication network failure, or any other circumstance beyond its reasonable control.

10.3 Website content

SomnioCare strives to keep the information on somniocare.com accurate and up-to-date, but does not guarantee the completeness or absolute accuracy of this information. SomnioCare reserves the right to modify the content of the site at any time without notice.


Article 11 — Personal Data Protection (GDPR)

11.1 Data controller

11.2 Data collected

SomnioCare collects the following data as part of its services: first and last name, email address, delivery postal address, telephone number (optional), website browsing data (cookies), and order history.

11.3 Purposes of processing

This data is collected and processed for the following purposes: processing and tracking orders, communication relating to orders, sending marketing communications with prior consent, improving the user experience on the site, and compliance with legal and accounting obligations.

11.4 Retention period

Order-related data is retained for a period of 10 years in accordance with Belgian accounting obligations. Marketing data is retained until the Customer withdraws their consent.

11.5 Data subjects' rights

In accordance with the GDPR (EU Regulation 2016/679), the Customer has the following rights regarding their personal data: right of access, right to rectification, right to erasure, right to restriction of processing, right to data portability, and right to object. To exercise these rights, the Customer can contact SomnioCare at support@somniocare.com. In case of an unresolved complaint, the Customer may lodge a complaint with the Belgian Data Protection Authority (APD) at contact@apd-gba.be.

11.6 Cookies

The somniocare.com website uses technical cookies necessary for the functioning of the site as well as analytical and marketing cookies with the Customer's prior consent. The Customer can manage their cookie preferences via the consent banner displayed during the first visit or from their browser settings.

11.7 Data transfer

Customers' personal data may be transferred to the following service providers strictly within the framework of order fulfillment: payment providers, logistics providers and carriers, emailing providers. These service providers are contractually committed to respecting the confidentiality and security of data in accordance with the GDPR. No data is sold or transferred to third parties for commercial purposes.


Article 12 — Intellectual Property

12.1 Website content

All elements constituting the somniocare.com website — including the SomnioCare brand name, logo, texts, visuals, photographs, videos, the structure and architecture of the site — are the exclusive property of SomnioCare and are protected by Belgian and European intellectual property law.

12.2 Prohibitions

Any reproduction, representation, modification, publication, adaptation, or exploitation of all or part of the site's content, by any process whatsoever, is strictly prohibited without the prior written authorization of SomnioCare. Any violation of these rights may lead to legal proceedings.

12.3 Hyperlinks

The creation of hyperlinks to somniocare.com is authorized provided that it does not harm SomnioCare's image and is not carried out for commercial purposes without prior agreement. SomnioCare reserves the right to request the removal of any link it deems non-compliant.


Article 13 — Amendments to the GCS

SomnioCare reserves the right to modify these General Conditions of Service at any time, particularly to comply with changes in applicable legislation. The applicable GCS are those in force at the time of the order. The Customer will be informed of any substantial modification by email or via a notification on the website.


Article 14 — Dispute Resolution

14.1 Amicable settlement attempt

In the event of a dispute relating to an order or the performance of these GCS, the Customer is invited to first contact SomnioCare customer service at support@somniocare.com in order to find an amicable solution. SomnioCare undertakes to respond within 5 working days and to make every effort to resolve the dispute to the Customer's satisfaction.

14.2 Mediation

If no amicable solution can be found within 30 days, the Customer may have recourse to a free consumer mediation service. In Belgium, the Customer can contact the Consumer Mediation Service (SMC) via the website mediationconsommateur.be. The Customer can also use the European online dispute resolution platform accessible at ec.europa.eu/consumers/odr.

14.3 Applicable law and competent jurisdiction

These GCS are governed by Belgian law. In the event of a dispute not resolved amicably or through mediation, the competent courts of the judicial district of SomnioCare's registered office shall have sole jurisdiction, unless mandatory legal provisions applicable to the consumer customer stipulate otherwise.
